Terms of Use

The agreement that governs your use of KinectedCare. Please read it carefully.

Our services

Our goal is to help you care for an aging adult — or anyone who needs group support — and help them live independently.

Required devices

The person being cared for must have a compatible smartphone, and may add a compatible smartwatch to share activity data with Google Health and/or Apple Health. That person must agree to KinectedCare's permission request to share health data with the team caring for them.

Medical advice disclaimer

Information, data, and alerts from KinectedCare are for informational or educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. All users are strongly encouraged to consult qualified healthcare professionals for any medical concerns. All use is at the user's own risk and does not establish a patient-provider relationship. Do not use this device if your healthcare provider has advised that it is contraindicated for your condition.

Use of KinectedCare is not a substitute for emergency medical services. If you experience an emergency, you must immediately suspend your use of KinectedCare and call local emergency service providers. Most smartphones have an "Emergency Call" button accessible from the lock screen on both iPhone and Android, allowing you to dial emergency services without unlocking the phone.

Combating harmful conduct

People communicate openly when they feel safe and welcomed. Do not use KinectedCare for hateful or harmful activities.

Do not use KinectedCare if

• You are prohibited from receiving our products, services, or software under applicable laws; or
• We previously disabled your account for violating our terms or policies.

Acceptable use

We want people to use KinectedCare to express themselves and share what matters to them. You agree not to engage in — or help others engage in — the following. You may not use our products: in a way that violates these Terms or related policies; in a way that is unlawful; to upload viruses or malicious code, or to do anything that could disable, overburden, or impair our products; to access our servers or data you do not have permission to access; or to disassemble or reverse-engineer our products.

Protecting children

Users must not discuss, upload, share, or solicit any content involving the sexual exploitation of children. Violations result in content removal and a permanent ban. If you suspect any such violation, report it immediately to local law enforcement and notify us at support@steamboatsoftware.com. See our Child Safety Standards Policy.

No service level agreement

We're building a community we hope will grow and thrive; we make no stated or implied service-level agreement or assurance of delivery. KinectedCare operates using your devices' data over cellular and/or Wi-Fi connections, and service will vary with your network's strength and speed. We do not assume responsibility for those data services. You assume full responsibility for cellular and Wi-Fi data consumption, usage fees, and roaming fees.

Updating our terms

We work constantly to improve our services and may need to update these Terms from time to time to reflect our services and practices. We reserve the right to update these Terms at any time without notice.

Limits of liability

Our products are provided "as is," and we make no guarantees that they will always be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we disclaim all warranties, whether expressed or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not control what people do or say and are not responsible for their actions, conduct, or content. To the fullest extent permitted by applicable law, under no circumstances will we be liable to you for any medical-provider costs, medical-emergency costs, lost profits, revenues, loss of information or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or our products, even if we have been advised of the possibility of such damages. Our aggregate liability will not exceed the greater of $1 USD or the amount you have paid us in the past 90 days.
